The No Hidden Fees Act: A Step Towards Transparency

The hospitality industry is taking a significant step towards greater transparency with the recent passing of the No Hidden Fees Act by the U.S. House of Representatives.

According to the AHLA, only 6 per cent of hotels nationwide currently charge a mandatory resort/destination/amenity fee, with an average cost of $26 per night.

However, the lack of a universal standard for displaying such fees can often lead to confusion and frustration for guests. Clear and upfront pricing not only benefits consumers by allowing them to make informed booking decisions but also creates a level playing field for all lodging businesses.

This act, championed by the American Hotel & Lodging Association (AHLA), aims to ensure clear and consistent communication of mandatory fees across the entire lodging landscape, from hotels to short-term rentals.

Here at Inside Hospitality Solutions (IHS), we applaud this development and believe it will benefit both guests and lodging establishments.

Why Transparency Matters

Imagine booking a dream vacation only to discover hidden fees at checkout that significantly inflate the advertised price. Unfortunately, this scenario is all too common for many travelers.

A recent study by Hospitality Financial and Technology Professionals (HFTP) revealed that 82 per cent of travelers find hidden fees frustrating and misleading. The No Hidden Fees Act directly addresses this concern by requiring all lodging businesses, including:

  • Hotels
  • Short-term rental platforms (e.g., Airbnb, Vrbo)
  • Online travel agencies (OTAs)
  • Metasearch sites (e.g., Kayak, Google Hotels)

To clearly disclose mandatory fees upfront during the booking process. This includes resort fees, amenity fees, cleaning charges, and any other unavoidable costs associated with the stay.

The No Hidden FEES Act addresses this issue head-on. By establishing a standardized approach to displaying mandatory fees, guests will know precisely what they’re paying for upfront. This fosters trust, transparency, and a more positive booking experience.

No Hidden Fees better for customer experience

Benefits for Guests and Lodging Businesses

For Guests:

  • Informed Decisions: Knowing the total cost of a stay upfront empowers guests to make informed booking decisions based on their budget and priorities.
  • Reduced Frustration: Transparency eliminates the unpleasant surprise of hidden fees at checkout, leading to a more positive guest experience.
  • Increased Trust: Clear communication fosters trust between guests and lodging businesses, strengthening the hospitality experience.

For Lodging Businesses:

  • Enhanced Customer Satisfaction: Transparency builds trust with guests, leading to higher satisfaction and potentially repeat business.
  • Fair Competition: A level playing field ensures all lodging businesses compete based on value proposition rather than hidden costs.
  • Improved Brand Reputation: A commitment to transparency strengthens a lodging establishment’s brand reputation and fosters positive online reviews.

Beyond the No Hidden Fees Act

While the No Hidden Fees Act is a significant step forward, more needs to be done to achieve complete lodging transparency.

The passage of the No Hidden FEES Act by the House is a significant step forward, but it still needs Senate approval to become law. Senators Amy Klobuchar and Jerry Moran introduced a similar bill, the Hotel Fees Transparency Act (S. 2498), which the Senate is currently considering.

Here at IHS, we recommend the following additional measures:

  • Standardizing Fee Terminology: Consistent use of clear and concise language for fees across the industry can further eliminate confusion for guests.
  • Tax Breakdown: Providing a detailed breakdown of all taxes associated with the stay can help guests better understand the final cost.
  • Make fees easy to find. Don’t bury them in fine print. Feature them prominently during the booking process.
  • Explain the value of fees. Briefly explain what guests receive in exchange for mandatory fees.
  • Transparency in Promotions and Packages: Clear communication regarding inclusions and exclusions in promotional offers and packages ensures guests know precisely what they are getting.

By working together to implement these measures, the hospitality industry can create a more transparent and trustworthy experience for all. Inside Hospitality Solutions is dedicated to supporting our clients in navigating the evolving regulatory landscape and implementing best practices for fee communication.

Looking Ahead

The passing of the No Hidden Fees Act in the House marks a significant victory for lodging transparency. We eagerly await the Senate’s consideration of the Hotel Fees Transparency Act and anticipate its passage into law. Senators Amy Klobuchar (D-Minn.) and Jerry Moran (R-Kan.) have already introduced a similar bill. At IHS, we remain committed to informing you about these developments and providing the resources you need to thrive in a transparent lodging environment.
